California Consumer Privacy Act (CCPA) Notice

Effective Date: February 4, 2020

FOR RESIDENTS OF CALIFORNIA ONLY

This California Consumer Privacy Act Notice (the “CCPA Notice”) supplements VGI’s Privacy Policy and provides additional information to California residents who are Users with personal information processed by VGI pursuant to the California Consumer Privacy Act of 2018 (the “CCPA”).

Except as otherwise specified in this CCPA Notice, all terms used in this CCPA Notice and not specially defined shall have the same meanings as ascribed to them in VGI’s Privacy Policy, or as otherwise defined in the CCPA.

Right to Access

If you are a California resident, you may submit, free of charge, but no more than twice in a 12-month period, a verifiable request for the following information:

  • The categories and specific pieces of personal information that VGI has collected, sold or disclosed for a business purpose about you within the preceding 12-month period;
  • The categories of sources from which the personal information was collected;
  • The purposes for which the information was collected or sold; and
  • The categories of third parties to whom the information was sold, disclosed for a business purpose, or otherwise shared.

If possible, VGI will try to provide this information to you in a readily usable format that allows transmission to another entity.

Right to Deletion.

If you are a California resident, you may submit a verifiable request for VGI to delete any personal information that VGI has collected from you. This right is not absolute, and under some circumstances, VGI is not required to delete your information.

Right to be Free from Discrimination.

VGI may not discriminate against you because you have chosen to exercise your rights, including, for example, by denying you access to VGI’s online Services or charging you different rates or prices for the same online services, unless that difference is reasonably related to the value provided by your data.

VGI does not sell personal information.

For the purposes of the CCPA, the terms “sell,” “selling,” “sale,” or “sold,” means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to another business or a third party for monetary or other valuable consideration.

 

As of the Effective Date of this CCPA Notice, VGI does not sell personal information

Under the CCPA, VGI is required to provide you with lists of the categories of personal information that VGI has collected, sold or disclosed about California residents in the preceding 12 months, by reference to the categories enumerated in the CCPA. Use of Personal Information.

VGI may use or disclose the personal information that we collect for one or more of the following business purposes:

  • To provide the Services;
  • For analytics and research purposes;
  • To help improve the Services;
  • To troubleshoot, track crash events, and resolve any issues;
  • To develop future implementations of the Services;
  • To evaluate and improve marketing and promotional activities;
  • To display ads;
  • Player acquisition;
  • To respond to and communicate with Users;
  • To provide customer service and support;
  • To process transactions and fulfill orders;
  • Security purposes;
  • As required by applicable law, or other effective court order, or governmental regulations.
  • As specified when personal information is collected, or as otherwise set forth in the CCPA.
  • In connection with a potential merger, acquisition, bankruptcy, or other transaction in which a third party assumes control of all or part of the business of VGI.

Children Under 16 Years Old.

The VGI Services are intended for adults only. If you are under 21 years old, you are not permitted to use the Services. VGI does not knowingly collect any personal information from Users under 16 years of age, and especially not from any children under 13. If we learn that we have unintentionally collected any personal information from a child under the age of 13, we will immediately delete the information from our records.

Changes to this CCPA Notice

VGI may elect to change this CCPA Notice at any time and from time to time, and VGI hereby reserves the right to change this CCPA Notice, at our sole discretion, at any time and in any way that VGI may deem appropriate. If VGI decides to make any material changes to this CCPA Notice, then VGI will attempt to give you notice by posting on the Site or within the Service or the affected App, or by sending a message informing you of the modified terms or conditions with a link to the updated CCPA Notice. However, VGI reserves the right to make changes immediately, as determined in our sole discretion. You agree to periodically check the Services, and to read and familiarize yourself with any modifications to this CCPA Notice. All applicable changes will go into effect on the corresponding Effective Date set forth above in the revised CCPA Notice.
